RegPing Terms of Service

1. Agreement

By adding any RegPing bot to a Discord server, using a RegPing slash command, or maintaining an active RegPing subscription, you ("you," "Server Administrator," or "Subscriber") agree to be bound by these Terms of Service ("Terms"). If you do not agree, remove the RegPing bot from your server and discontinue use immediately.

These Terms are between you and the individual operator of RegPing ("RegPing," "we," "us," or "our"), reachable at michael@complianceghost.com.


2. Description of Service

RegPing is a suite of Discord application bots that monitor publicly available government and regulatory data sources — including but not limited to FDA recalls, US financial-regulator enforcement actions, US state cannabis regulations, and AI/privacy legislation — and deliver filtered summary alert embeds into a subscribing Discord server's designated channel.

RegPing republishes information from public sources on a quote-and-link basis, attributing content to the originating government agency or regulator and linking to the primary source. RegPing does not generate original legal analysis, and its alert content consists of summaries of, and excerpts from, publicly available government-published materials.

REGPING IS AN INFORMATION SERVICE. IT IS NOT A LAW FIRM AND IT DOES NOT PROVIDE LEGAL ADVICE.

THE ALERTS, SUMMARIES, AND CONTENT DELIVERED BY REGPING DO NOT CONSTITUTE LEGAL ADVICE, REGULATORY GUIDANCE, COMPLIANCE COUNSEL, OR ANY OTHER FORM OF PROFESSIONAL ADVICE. NOTHING IN REGPING'S OUTPUT CREATES AN ATTORNEY-CLIENT RELATIONSHIP OR ANY OTHER PROFESSIONAL RELATIONSHIP BETWEEN REGPING AND ANY USER OR SERVER.

REGULATORY REQUIREMENTS APPLICABLE TO YOUR BUSINESS OR SITUATION ARE FACT-SPECIFIC AND JURISDICTION-SPECIFIC. YOU MUST CONSULT A QUALIFIED ATTORNEY, COMPLIANCE PROFESSIONAL, OR OTHER APPROPRIATE LICENSED EXPERT BEFORE MAKING ANY BUSINESS, LEGAL, OR COMPLIANCE DECISION BASED ON INFORMATION RECEIVED FROM REGPING.

DO NOT RELY ON REGPING ALERTS AS A SUBSTITUTE FOR PROFESSIONAL LEGAL OR REGULATORY COUNSEL.


4. Accuracy and Source Limitations

RegPing retrieves and republishes information from public government and regulatory sources. By using RegPing you acknowledge and accept that:

  1. Sources may be delayed. Government agencies may publish updates, amendments, or corrections on their own schedules. RegPing's monitoring is not instantaneous and alerts may not reflect real-time regulatory status.
  2. Errors may occur. RegPing's automated processing and AI-assisted summarization may introduce inaccuracies, omissions, or mischaracterizations of source material. Summaries are not a substitute for reading the primary source document.
  3. Sources change. Regulatory websites, feed formats, and data availability change without notice. RegPing may be unable to monitor a given source for periods of time due to upstream changes beyond our control.
  4. Coverage is not exhaustive. RegPing covers specific regulatory domains as described in its product listing. It does not cover all agencies, jurisdictions, or regulatory areas.
  5. Primary sources govern. In any case of conflict between a RegPing alert and the actual text published by the originating government agency, the primary source controls.

You are solely responsible for independently verifying any information received through RegPing before acting on it.


5. Acceptable Use

You agree to use RegPing only for lawful purposes and in accordance with these Terms and Discord's Terms of Service. You must not:

We reserve the right to terminate access for any server that violates these Terms.


6. Subscriptions and Billing

RegPing's paid subscription tiers are offered through Discord's Premium Apps / Guild Subscriptions system. Billing, payment processing, refunds, and subscription management are handled entirely by Discord, Inc. in accordance with Discord's own terms and policies.

We do not collect, process, or store payment card numbers, bank account information, or any other financial account data. All payment-related inquiries must be directed to Discord support.

Subscription entitlement is determined by Discord's platform. Features gated to paid tiers will be available only while Discord reports your server as having an active entitlement. We are not responsible for delays or errors in Discord's entitlement reporting.

We reserve the right to modify subscription pricing or tier features with reasonable advance notice posted to RegPing's official Discord support server or application listing.


7. Intellectual Property

RegPing software and branding. The RegPing bots, code, branding, logos, and non-government-sourced creative elements are owned by or licensed to the RegPing operator and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use RegPing's services as described herein. No other license is granted.

Government-sourced content. Alert content derived from US federal and state government publications is generally in the public domain or published for public dissemination. RegPing republishes such content on a quote-and-link basis and does not claim copyright in government-authored material. Attribution to the originating agency and a link to the primary source are included in each alert embed.

AI-generated summaries. Short summaries generated with the assistance of the Anthropic Claude API are intended solely as convenience aids for reading the underlying public source material. They are not independent works of authorship asserted by RegPing; all substantive regulatory content originates from the cited government source.


8. No Warranty

THE REGPING SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, TIMELINESS, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

WE DO NOT WARRANT THAT REGPING WILL DETECT, CAPTURE, OR DELIVER ALL RELEVANT REGULATORY EVENTS; THAT ALERTS WILL BE FREE FROM ERRORS OR OMISSIONS; OR THAT THE SERVICE WILL BE AVAILABLE AT ANY PARTICULAR TIME.


9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  1. IN NO EVENT WILL REGPING OR ITS OPERATOR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF REVENUE, LOSS OF DATA, LOSS OF GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  2. IN NO EVENT WILL REGPING'S TOTAL AGGREGATE LIABILITY TO YOU EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID FOR THE REGPING SUBSCRIPTION IN THE THREE (3) MONTHS PRECEDING THE CLAIM; OR (B) ONE HUNDRED US DOLLARS (USD $100).

  3. REGPING EXPRESSLY DISCLAIMS ANY LIABILITY FOR RELIANCE ON REGPING ALERTS IN MAKING LEGAL, COMPLIANCE, BUSINESS, FINANCIAL, OR REGULATORY DECISIONS. YOU ASSUME FULL RESPONSIBILITY FOR ANY SUCH DECISIONS.

  4. REGPING IS NOT LIABLE FOR MISSED, DELAYED, DUPLICATED, OR ERRONEOUS ALERTS CAUSED BY UPSTREAM SOURCE CHANGES, DISCORD PLATFORM OUTAGES, CLOUDFLARE INFRASTRUCTURE ISSUES, OR ANY OTHER FACTOR OUTSIDE OUR DIRECT CONTROL.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability is limited to the maximum extent permitted by law.


10. Indemnification

You agree to defend, indemnify, and hold harmless the RegPing operator and any affiliated persons from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of RegPing; (b) your violation of these Terms; (c) your reliance on RegPing's output in any legal, compliance, or business decision; or (d) your violation of any third-party rights.


11. Termination

By you. You may terminate your use of RegPing at any time by removing the bot from your server or using the /unsubscribe command. Subscription billing is managed by Discord and must be cancelled through Discord's interface.

By us. We may suspend or terminate your server's access to RegPing at any time, with or without notice, for violation of these Terms, abuse of the service, non-payment (as determined by Discord's entitlement system), or any other reason at our discretion.

Effect of termination. Upon termination, your server's configuration data is eligible for deletion within 90 days as described in our Privacy Policy. Provisions of these Terms that by their nature should survive termination (including Sections 3, 4, 7, 8, 9, and 10) will survive.


12. Third-Party Services and Links

RegPing's alert embeds include links to primary government and regulatory sources. We are not responsible for the content, accuracy, availability, or practices of those external sites. Use of linked sources is governed by those sites' own terms and policies.

RegPing operates on Discord's platform and relies on Cloudflare and Anthropic as infrastructure providers. We are not responsible for the availability, terms, or practices of those third-party services, though we have described their roles in our Privacy Policy.


13. Changes to These Terms

We may update these Terms at any time. Material changes will be announced via RegPing's official Discord support server or application listing. Your continued use of RegPing after the effective date of updated Terms constitutes your acceptance of those Terms. If you do not accept revised Terms, you must remove the bot from your server.


14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, United States, without regard to conflict-of-law principles. Any dispute arising under or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of the Commonwealth of Massachusetts, United States.

Nothing in these Terms prevents either party from seeking injunctive or other equitable relief in any jurisdiction for violations of intellectual property rights or unauthorized access.


15. Entire Agreement

These Terms, together with the RegPing Privacy Policy, constitute the entire agreement between you and RegPing with respect to the service and supersede all prior agreements, representations, and understandings. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force.
